Prevention of disputes is one of the most important processes that determine the performance of a construction project and it depends highly on a sound understanding of dispute causation.
The effect of dissatisfaction with the traditional systems of dispute resolution has therefore led to interest in alternative dispute resolution (ADR) in its advantages in terms of costs, speed and flexibility.
The webinar, hosted by Association of South African Quantity Surveyors (ASAQS), is delivered in two 3-hour sessions and comprises of five parts, each one contributing to an understanding of the aspects of the construction sector that are impacted by the regular occurrence of disputes, an overview of the various existing dispute resolution options that are available, how the various standard forms of contract, endorsed by the Construction Industry Development Board (CIDB), provide for ADR mechanisms in their contracts, and finally the role of the expert witness in ADR or court of law. The course content includes working through five scenarios and a questionnaire to establish one’s readiness to act as an expert witness.
The course, which is CPD accredited, will be presented by Prof Tinus Maritz, a Registered Professional Quantity Surveyor and a life member of the Association of South African Quantity Surveyors. He has vast experience in practice and academia, specialising in the field of construction law during the latter part of his career, and is regarded as an authority on the subject of this course.
